Ujogo Points Program Rules
Ujogo, Inc. ("Provider") offers a Frequent Player Points Program (the "Ujogo Points Program"), which is governed by this agreement ("Agreement") and the Terms and Conditions of Use governing Provider's Ujogo website ("Website"). The Ujogo Points Program is owned by Provider and exclusively designed for users with a Provider account ("User" or "You") to redeem points earned through Provider's Website. Provider may periodically change the terms and conditions of this Agreement without notice to you, by posting an updated Agreement on Provider's Website, and your continued enrollment and use of the Ujogo Points Program signifies your acceptance of any changed terms.
BY CREATING AN ACCOUNT, YOU WILL BE ENROLLED IN THE UJOGO POINTS PROGRAM. YOUR PARTICIPATION IN THE UJOGO POINTS PROGRAM IS EXPRESSLY CONDITIONED UPON YOUR COMPLIANCE WITH OUR AGE REQUIREMENT AND AGREEMENT TO ABIDE AND BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, TO WHICH YOU AGREE TO IF YOU ACCESS OR USE THE UJOGO POINTS PROGRAM. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MAY NOT ACCESS OR USE THE UJOGO POINTS PROGRAM. YOU MAY PRINT THESE PAGES FOR YOUR RECORDS.
1. Eligibility.
To be eligible to participate in the Ujogo Points Program, you must be at least 18 years of age or older and a legal resident of the United States including the District of Columbia, but not including Oklahoma and Mississippi. The Ujogo Points Program is limited to individuals only; corporations or other business entities may not participate in the Ujogo Points Program. Ujogo Points Program membership is limited to one individual per account and one account per individual. By accessing or participating in the Ujogo Points Program, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. Provider reserves the right, in its sole and absolute discretion, to refuse service and access to any participant. Employees, officers, directors, investors, agents, and representatives of Provider and their parents, affiliates and subsidiaries, and each of their respective immediate family (defined as parents, spouse and children) and any person residing in the same household as such and sponsors and affiliates and advertising and promotion agencies of Provider are NOT eligible to participate in the Ujogo Points Program. Provider reserves the right to limit Ujogo Points Program enrollment at any time.
2. Registration.
In order to participate in the Ujogo Points Program and earn Ujogo Points ("Points"), you must be a Provider member and have created an account. You will automatically be enrolled in the Ujogo Points Program when you become a Provider member. You agree to maintain and promptly update all personal information on your account and keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, Provider may suspend or terminate your account immediately and may refuse you all current or future use of the Ujogo Points Program. User accounts may not be merged under any circumstances.
3. Acquiring and Redeeming Points.
Points may be earned for a number of activities. These activities may include, but are not limited to, becoming a member, entering tournaments, time of play, number of games played in any given month, and/or referring a friend. Points can be redeemed at the Ujogo Store, located here. Provider reserves the right to modify the acquiring and redeeming of points at any time without prior notice, including, but not limited to, changing, adding, or removing methods by which Users can earn or redeem Points, or imposing restrictions on the redemption of Points.Each User is responsible for ensuring the accuracy of User's account. Users are encouraged to check their accounts to ensure that the correct number of Points have accrued to the User's account. If a User believes that Points were not properly accrued to the User's account, User must notify Provider at support@ujogopoker.com.
Provider's decisions regarding the awarding of Points are final and binding. Actions by Users that are determined to be invalid or improperly obtained for any reason are subject to disqualification and the corresponding Points will be removed from the User's account.
4. Disclaimer of Warranties.
a. You expressly agree that use of Ujogo Points Program is at your sole risk. The Ujogo Points Program and all goods and services offered therein are provided on a strictly "as is" and "as available" basis. Provider MAKES NO WARRANTY WITH REGARD TO ANY GOODS, SERVICES, OR POINTS OBTAINED BY YOU THROUGH PROVIDER OR THROUGH PROVIDER'S ADVERTISERS, PARTNERS, MANUFACTURERS OF MERCHANDISE, OR SUPPLIERS OF SERVICES; THAT PROVIDER WILL MEET YOUR REQUIREMENTS IN ANY MANNER; OR THAT PROVIDER'S WEBSITE WILL BE UNINTERRUPTED, TIMELY, ERROR FREE; NOR DOES PROVIDER MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE UJOGO POINTS PROGRAM OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH PROVIDER OR ITS WEBSITE.
b. PROVIDER EXPRESSLY DISCLAIMS ANY AND ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PROVIDER SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES, WARRANTIES, AND REPRESENTATIONS, IF ANY, OFFERED BY PROVIDER ADVERTISERS, PARTNERS, MANUFACTURERS OF MERCHANDISE, OR SUPPLIERS OF SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PROVIDER'S WEBSITE OR THROUGH PROVIDER SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
5. Limitation of Liability.
a. PROVIDER SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL, RELATING TO THE PARTICIPATION OR INABILITY TO PARTICIPATE IN PROVIDER. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
b. Provider is not responsible for damages or losses that result from participating or inability to participate in the Ujogo Points Program, or reliance on or use of information, services, or merchandise provided on or through Provider and its Website.
6. Indemnification.
You agree to indemnify and hold Provider, its affiliates, officers, and employees harmless from any claim, demand, expense, or damage, including reasonable attorneys' fees relating to your use of the Ujogo Points Program or violation of this Agreement.
7. Termination.
AT ANY TIME EITHER YOU OR PROVIDER MAY TERMINATE YOUR ACCOUNT WITH OR WITHOUT CAUSE. YOUR RIGHT TO USE YOUR ACCOUNT AND THE UJOGO POINTS PROGRAM IMMEDIATELY CEASES UPON TERMINATION AND YOUR UNREDEEMED POINTS SHALL BE CANCELLED. Termination of your account by you is effective upon you submitting a termination request through the Provider website at support@ujogopoker.com. You understand that, in some cases, you may still receive messages, which may have been scheduled prior to your termination, after termination. You may not earn Points after termination. Provider reserves the right to terminate the account of any User who appears to be using the Ujogo Points Program in a manner inconsistent with this Agreement, the intent of this Agreement, or any Provider rules.
8. Sole Remedy.
Should you object to any of the terms and conditions of this Agreement, or any subsequent modifications thereto, or become dissatisfied with Provider, your only recourse is to immediately discontinue your participation in the Ujogo Points Program and properly terminate your account, as identified above.By enrolling in the Ujogo Points Program and/or by clicking the "I HAVE READ AND AGREE TO THE TERMS AND CONDITIONS OF USE" button, you represent that you have read this Agreement in its entirety, understand its terms and conditions, are duly authorized to execute this Agreement on behalf of yourself, and you agree to be bound by the terms and conditions of this Agreement.
